Below are my Terms and Conditions, it's always a good idea to read these before booking.
Terms and conditions can seem a little scary but I need to have them to protect my business and protect your rights too.
In the following terms & conditions “the photographer” shall mean Nami Creative. “The client(s)” shall be those persons defined as the person being photographed and/or booking the photo session. These terms and conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing.
Mutual Understanding
This agreement contains the entire understanding between Nami Creative and the client(s). The client(s) understand the package selected and is/are happy to book in with Nami Creative.
COPYRIGHT
All digital files are copyrighted and are the property of Nami Creative. The digital files are the client(s) property for personal use and the purpose of reproduction and distribution to friends and relatives.
WEBSITE DISPLAY & PROMOTIONAL USAGE
The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc. Unless specifically asked not to in writing by the client.
BOOKING FEE
Upon your deposit ($200NZD) Nami Creative will reserve the date agreed upon, and will not make other reservations for that date. For this reason, the deposit is non-refundable. The date is non transferable unless prior discussed. In case of the clients decision to change the date to a new date another deposit of $200 has to be paid to secure the new date.
The outstanding balance is due 2 weeks prior to your Photo Shoot.
Cancellation of Booking
The client understands that: Where the client cancels a booking appointment, the client is LIABLE to and agrees to PAY a cancellation fee of $150, regardless of whether the appointment is attended or not. The money paid to the photographer towards the booking/appointment can be applied towards another session to the value of the amount paid, at the photographer discretion.
Cooperation
The photographers shooting schedule, style of working and experience is designed to achieve a great experience and set of memorable photos for the client(s). Both the client(s) and the photographer therefore agree that punctuality and cheerful cooperation are essential to producing outstanding photographic results. In cases where the client(s) does not run on time (for example, extreme lateness of the client(s)) the photographer can not guarantee to take the normal set of photos although the photographer will do the absolute best to compensate. The client(s) agree to assist and cooperate with the photographer in obtaining the desired photographs; taking time to pose for the photographer at direction; pre-shoot consultations etc. The photographer should not be responsible for photographs not taken as a result of your failure to provide reasonable assistance or cooperation.
FORCE MAJEURE OR ACT OF GOD
In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.
If the weather isn’t suitable this will be decided by the photographer and a suitable date will be arranged. No booking fees will be refunded in this instance as weather conditions are out of the photographers control. If due to Covid restrictions the photoshoot can't be completed a new suitable date will be arranged.
LICENCE
The photographer shall be granted artistic licence in relation to the poses photographed, the location used and digital retouching. The photographers’ judgement regarding the locations, poses and number of photographs taken shall be deemed to be correct.
STORAGE
The photographer will retain your photographs for a period of time of one month, yet it is the client(s) responsibility to back up the photos onto additional USB’s /computers and hard drives.
Privacy
The photographer respects the client(s) privacy and personal information is not shared with any third party or other organisations.
Editing Procedure
The photographer reserves the rights to edit the photos at her own liking. If the client(s) wishes to have all photos edited in a specific way post receiving the images this comes at an extra cost.
